TXTPower hits NTC ruling, mulls suing commissioners before the Ombudsman

Texting TXTPower today denounced the decision of the National Telecommunications Commission dismissing the complaint against Globe Telecom over the company’s 100 percent increase in unlimited texting rates in February this year.

Aside from filing an appeal, TXTPower is studying possible legal moves against commission officials.

“The NTC dismissed our complaint on highly questionable grounds, by obscenely parotting Globe Telecom’s dangerous claim that we do not have a legal personality to file a complaint in the first place,” said TXTPower convenor Anthony Ian Cruz.

“Any citizen or group of citizens have a right to redress of grievances and should be heard by government, especially agencies such as the NTC,” said Cruz.

“This horrible idea adopted by the NTC is borrowed entirely from Globe’s motion to dismiss our complaint,” Cruz stressed. “We already demolished this false reasoning in our reply filed by our lawyer.”

The NTC approved in January Globe’s price hike that saw unlimited texting rates go up from P50 for five days to P80 for four days. No hearing was conducted to solicit public sentiments on the matter.

“We will appeal this decision not only because it dismissed our complaint on questionable grounds,” said Cruz. “More importantly, it fails to explain why the NTC approved the 100 percent price increase and why the NTC issued but did not enforce two orders directing Globe to suspend the price hike.”

“In a sense, the NTC did a Pontius Pilate with its decision,” said Cruz. “By unjustly dismissing the complaint, the NTC further beats up TXTPower and consumers while letting Globe and the agency itself off the hook.”

Cruz said that charges may also be brought against NTC officials over the fiasco, including the NTC’s refusal to implement a written order from the Commissioner and a cease-and-desist order issued by the Commission en banc in connection with the TXTPower complaint.

“The NTC obviously allowed Globe to ignore and violate its order and thus caused irreparable injury against consumers. By not enforcing its orders, the NTC allowed Globe to continue with its price hike,” said Cruz. “This is an issue which the Ombudsman should check.”

Ngey umaasa pa kayo? Hehe. hay txtpower it’s obvious na na talo na kayo. Kala nga namin you have shut up your mouth na. Umaasa paba kayo na may maniniwala pa sa inyo? Wala na…puro lang kayo salita. Kita nyo nmn 1.3 million ang increase ng Globe users on the first quarter of 2007 at kahit nagdecrease and profit by 25% but still their EBITDA on Q1 2007nagpapatunay na hindi sila affected sa boycott nyo. Mas mataas yon ng 1% compare last year.

txtpower, you guys really are a joke. first you lead us on a wild ride with promises. i was even one of your most ardent supporters. then your leaders, especially tonyo abandon us to concentrate on his “amo”. you leave us hanging despite countless requests by me and others to update us on what you’re doing. then it becomes clear you’re devoting your time to politics even endorsing a party list group, after redesiging your site and you expect us to believe you are doing something? read again your press release. there is nothing new in there. it’s a rehash of what happened months ago with ntc. we already know all this. the content of your press release is as useless as yesterday’s newspaper.

Kuya Hreyness musta na? Hehehe. Oo kuya ganon parin ang problem ng Sun. Para na akong tanga na nag-aupdate ng complaints pero hanggang ngayon wala paring pagbabago!!!! Grabe talaga ang Sun. Nanloloko tru its new SIMS. Hay kung totoo sana ang care ng Txtpower hindi sana sila nagfofocus sa isang bagay na talo na. Sana magfile sila ng complaints againts sun cellular. Ang smart millions ang nagrereklamo kasi ang hirap2x magpaunli hanggang ngayon walang improvements. Alam mo kuya gumaya rin ang smart sa Globe na nagtaas ng rates pro ang smart dinaan nila sa technical ways. For example sinasadya talaga ng smart na hindi ayusin ang system ng 258 unli nila. 12 pm palang ang reply ng 258 “SORRY HINDI MAPROCESS ANG IYONG REQUEST. MAG ALLTXT20 KA NALANG”. Nanotice mo na ang modus operande ng Smart kuya? Gusto nila na mag go sa alltxt20 ang mga users kasi 20 pesos for 1 day diba? Sa unli 15 kasi 15 lang per day ang maearn nila. Ito pa kuya ho just think of it. How come na mas una pa na naililagay sa Smartload menu ang alltxt denominations kaysa unlimited txt nila? Mas nauna sa market ang unli kaysa alltxt pro bakit anjan na sa menu ang alltxt na both alltxt and unlimited txts ginawa na nilang service? Ayan kuya obvious talaga. So kung ang mga gagong txtpower convenors are pro-consumers dapat bigyan rin nila ng pansin ang mga problem natin sa Sun at Smart diba? Inuuna pa nila ang kasong wala ng pag-aasa. Nagpapakahero ata ah. Hoy Tonyo kung totoong nag-aalala kayo sa mga cellphone users bakit ang problem at pang-aabuso ng Sun at Smart binabaliwala nyo lang? Saka kuya Henry maraming nagrereklamo na ang mga unli nila sa sun kinacut ng Sun. Ang 1 week unli ilang days lang!!!!

What is txtpower doing to the unlitxt of Globe? Until now words lang but no CONCRETE ACTIONS from you, txtpower.

I am tired of waiting. Always same reply na txtpower is doing something about it. For How many months na?????

If you are our consumer protector advocate, why are you diverting your attnetion into politics?

Haven’t you noticed, less and less people are now checking your website. It has been idle for how many months now and with no updates on our complaints.

I hope you can do CONCRETE ACTIONS instead of words.
